2. The Financial Services Authority (FSA)
The FSA is the independent watchdog that regulates financial services. It requires us to give you this document. Use this information to decide if our services are right for you.
3. Whose products do we offer?
We do not select products based on a “Fair Analysis” of the market. Instead, we offer products from a single insurer for each product type. You can ask us for the names of the insurers we use. Please note we are not contractually obliged to offer products in this way.
4. Which service will we provide you with?
You will not receive advice or a recommendation from us. We may ask some questions to narrow down the selection of products that we will provide details on. You will then need to make your own choice about how to proceed.
5. What will you have to pay us for this service?
Other than for Ring and Jewellery Insurance (where a fee of £2.50 is payable) and Payment Protection Insurance (where no fee is payable) we will charge you a fee of £20 when you first take out your policy. Our administrators, Berkeley Alexander Ltd, may also charge a fee of up to £20 if you make a change to your insurance cover mid-term (including requesting copy policy documents) and at each renewal. We will disclose fees to you where they are payable. Our fees are non-refundable, even if you cancel your policy.

8. Are we covered by the Financial Services Compensation Scheme (FSCS)?
We are covered by the FSCS. You may be entitled to compensation from the scheme if we cannot meet our obligations. This depends on the type of business and the circumstances of the claim. Insurance advising and arranging is covered for 100% of the first £2,000 and 90% of the remainder of the claim, without any upper limit.
9. Refund of premiums
In certain circumstances your insurer may repay part of your insurance premium(s) to us. This can occur where, for example, the risk covered by your policy is reduced (for example; a reduction in the value of your contents on a domestic home insurance policy) or the policy is cancelled. How we deal with this depends on the amount to be refunded;
This paragraph does not affect any cancellation/refund rights which Consumers may have.
10. Your legal duty to disclose information to us, Berkeley Alexander and insurance companies
It is your responsibility to provide complete and accurate information to insurers when you take out your insurance policy, throughout the life of the policy and when you renew it. It is important you ensure that all statements you make on any proposal form, claim forms or other document is full and accurate. Please note that if you fail to disclose any material information or change of circumstances to your insurers, this could invalidate your insurance cover and could mean that part or all of a claim may not be paid. We strongly recommend that the information provided is checked thoroughly prior to submission and that you keep a record of all correspondence supplied in relation to the arrangement of your insurance cover. Please also note that any renewal of insurance will be made in reliance upon the information provided by you in connection with your previous insurance policy – we and Berkeley Alexander will assume that such information remains correct unless you tell us otherwise.
11. Cancellation Rights
Cancellation rights vary between insurers and you should check your insurer’s documentation if you are considering cancelling your policy. If you are a Consumer and you exercise your right to cancel your policy within a 14 / 30 day cancellation period you will be charged for the period during which you were covered, and other charges may be applied to cover the insurer’s and our costs in arranging the cancelled policy, which will usually mean we or Berkeley Alexander will retain any fee charged.
12. Our right to set off monies you owe us
We or Berkeley Alexander shall be entitled (but not obliged) without notice to you to set off any amounts due to us from you against any amounts which we or Berkeley Alexander may receive on your behalf.
13. Insurer Solvency
Whilst we and Berkeley Alexander endeavour to place business with insurers with adequate levels of financial solvency we and Berkeley Alexander cannot guarantee the solvency of any insurer.
14. Notification of incidents
It is essential that you notify Berkeley Alexander immediately of all incidents or allegations that may result in a claim against your insurance policy. You must do so whether you believe you are liable or not. Any failure to do so may result in your insurer refusing to accept a claim. Any letter or other communication making allegations which could give rise to a claim which is received by you from any third party must be passed to Berkeley Alexander immediately, without acknowledgment. Only by providing prompt notification of incidents can your insurance company take steps to protect your interests.
15. How to make a claim
If you wish to report a claim or potential claim, please call the number shown in your policy document.
16. Payment of Premiums

Berkeley Alexander normally accept payment by cash, cheque, debit or credit card or monthly instalment. Time shall be of the essence, both as regards times, dates and periods specified in this paragraph and as to any times, dates or periods which we and Berkeley Alexander may agree can be substituted for any of them. In the event that you fail to pay any premium and/or fees when due your insurer may cancel your policy from the inception/renewal date and reject any claims thereunder. The acceptance by us of any payment from you (including the encashment of cheques) does not constitute acceptance of any risk by insurers or any commitment by us to arrange insurance cover on your behalf. Accordingly you should not assume that insurance cover is in place until you have received written confirmation of cover in the form of a cover note, policy certificate or equivalent.
17. Payment of premium using Third Party Instalment facilities
If you elect to pay for your insurance premium using Berkeley Alexander’s third party supplier, Premium Credit Limited (PCL), your details will be passed on to them. If any direct debit or other payment due in respect of the credit agreement you enter into with PCL to pay premiums is not met when presented for payment, or if you end the agreement with PCL, or if you do not enter into a credit agreement with PCL Berkeley Alexander will be informed of this by PCL. If you do not make other arrangements with Berkeley Alexander to pay your insurance premiums you acknowledge and agree that we or Berkeley Alexander may instruct on your behalf any relevant insurer to cancel the insurance and to collect any refund of premiums which may be made by the insurer, and if any money is owed to PCL under your credit agreement to pay it to PCL or if PCL have debited Berkeley Alexander with the amount outstanding, to use it to offset Berkeley Alexander’s costs.

To protect your interests and in the event that Berkeley Alexander do not receive your instructions and payment prior to the date of renewal, Berkeley Alexander reserve the right (but shall have no obligation) to renew your policy and (in the case of direct debit/instalment payments) to continue to accept payment from you unless and until you specifically notify Berkeley Alexander or your insurance company in writing that you wish to cancel your policy. Where Berkeley Alexander have assumed (in the absence of instructions to the contrary) that renewal is required you may be liable to make payment to us and/or your insurance company.
19. Confidentiality and Data Protection

We reserve the right to amend these Terms at any time during our appointment (including for the avoidance of doubt during the term of your insurance) by giving you not less than 7 days’ notice. We may assign or delegate all or any part of these Terms and/or the services to a third party without your prior consent where this will not significantly reduce any protections given to you under these terms or under the regulatory system.
